Divorce and Relationship Breakdown
If your marriage or civil partnership has come to an end, we can explain the divorce dissolution process to you carefully and clearly. To help you agree on important matters amicably, such as arrangements for looking after children and child maintenance, we facilitate communication with your former partner. We will also assist with discussions on the separation of money and property. Where an agreement is reached on these matters, you will usually be able to avoid court. However, where court action is necessary, we will ensure the best interests of you and your children are protected.
Some people prefer to obtain a legal separation rather than formally ending their marriage, by divorce. If this is the route you have chosen, we will guide you through the process of making your separation official.
Cohabitation Agreements
Cohabiting couples do not have the same rights under the law as those who are married or in civil partnerships, and this can cause issues if the relationship comes to an end. Many people now choose to enter into a cohabitation agreement in order to set out how assets will be divided if the relationship breaks down. It can also include terms relating to the care of children. At Sutton-Mattocks, we can help cohabiting couples to negotiate terms and ensure their cohabitation agreement is legally binding. It is important that you and your partner seek independent legal advice.
Pre and Postnuptial Agreements
Prenuptial agreements (commonly referred to as “prenups”) are made before a couple marries, and set out what should happen if the marriage breaks down – specifically relating to the assets owned by each person. A postnuptial agreement, on the other hand, is made after the couple is married. It has the same purpose as a prenuptial agreement, the only difference is the timing. Children - Private Law
We are able to assist and advise you in cases involving children, including living arrangements for children, contact and maintenance. When considering arrangements for children, the key consideration is always the best interests of the child or children. It is highly recommended that you attempt to reach an agreement on child arrangements, contact and maintenance out of court, as this will be the least disruptive and stressful for all those involved. Where agreement cannot be reached, however, we can guide you on the option available to resolute such matters.
Domestic Abuse
Domestic Abuse occurs when a spouse or partner causes you harm either emotionally, physically or financially. For many people it is difficult to accept they are in an abusive relationship. We can provide advice on the options available to you and this can include applying to the court for a non-molestation order and an occupation order in respect of your home.
